Consumers are entitled to a right of cancellation for contracts concerning the delivery of goods according to the following provisions.
A consumer is any natural person who enters into a legal transaction for purposes which are predominantly neither for their commercial purposes nor for their self-employed work.
Right of cancellation
You have the right to cancel this contract within one month without having to state your reasons.
The deadline for cancellation is one month after the day on which you or a third party named by you who is not the carrier have/has taken the last goods into your/their possession.
To exercise your right of cancellation, you must inform us (Zoomyo GmbH, Maxstrasse 16, 45127 Essen, Germany, +49 (0) 4821 / 77967-155 Email: firstname.lastname@example.org) of your decision to cancel this contract by submitting an unambiguous declaration (i.e. a letter sent by post, fax or e-mail). You can use the attached template cancellation form, although this is not obligatory.
You can also fill in the cancellation form template electronically or transmit another unambiguous statement on our website https://zoomyo.net/. If you make use of this option, we will send you an acknowledgement of receipt (e.g. via email) of such a withdrawal immediately.
In order to comply with the cancellation deadline, it is sufficient to send the letter informing us about your decision to exercise the right of cancellation before the deadline for cancellation.
Consequences of cancellation
Should you cancel this contract, we shall refund all payments we have received from you, including delivery costs (with the exception of any additional costs incurred by you choosing a delivery method other than the cheapest standard delivery offered by us), without undue delay and at the latest fourteen days after the day on which we have received your letter of cancellation of this contract. For this refund, we will use the same payment method that you used for the original transaction, unless another arrangement was expressly made with you; under no circumstances will you be charged for this refund. We may refuse to make repayments until we have received the returned goods or until you have provided proof that you have sent the goods – whichever happens first.
You must send back or return the goods to us without undue delay and, in any case, at the latest fourteen days after the day on which you inform us of the cancellation of this contract. The deadline shall be considered to have been kept if you send the goods before the expiration of the fourteen-day period. You shall bear the direct costs of sending back the goods.
You must only pay for a possible loss in value of the goods if this loss in value is attributable to dealing with the goods in a way which is not necessary to check its quality, properties and how it works.
